Reporting illegal content

1. Who can report
Anyone, individual or entity. You do not need to own the infringed right or to have any relationship with us: no account is required, and reporting is free.
2. How to report
Write to info@sponsalia.app with “DSA notice” in the subject line. It is the single channel, and a human being reads it.
3. What the notice must contain
For a notice to be actionable it has to include:
- an explanation of the reasons why you consider the content to be illegal;
- the exact address (URL) of the content. Invitations open through a link containing a code: paste it in full, otherwise the page cannot be reached and we cannot verify anything;
- your name and email address — not required where the notice concerns the offences referred to in Articles 3 to 7 of Directive 2011/93/EU;
- a statement that you believe, in good faith, that the information and allegations are accurate and complete.
If the notice concerns a piece of music, add the title and the artist and, where available, your role in relation to the work (author, publisher, label, collecting society) and the catalogue reference.
A notice containing all of the above gives us actual knowledge of the illegality: from that moment we have to act, and we do.
4. What happens next
We confirm receipt to your email address without undue delay.
We assess the notice in a timely, diligent, non-arbitrary and objective manner. No automated tools are used to decide: a person reviews it.
We notify our decision and the reasons for it both to you and to the customer who published the content, pursuant to Art. 17 of the Digital Services Act.
5. What we can do
Depending on the seriousness: remove the single file (the uploaded song, for example, replacing it with silence or with one of ours), disable access to the whole invitation, suspend or terminate the customer's account under clause 12 of the Terms of Service. Where there is a suspicion of a criminal offence involving a threat to the life or safety of a person, we inform the competent authorities.
6. If you disagree with the decision
Both the person who reported the content and the person who published it may reply to the same address with new elements: we will reconsider the case.
This is without prejudice to court proceedings and to the possibility of turning to an out-of-court dispute settlement body certified under Art. 21 of the Digital Services Act.
7. Manifestly unfounded notices
Frequently sending manifestly unfounded notices takes time away from the real ones: in such cases we may stop acting on further communications from the sender, after issuing a warning.
8. Point of contact
info@sponsalia.app is also the single point of contact for recipients of the service and for the authorities of the Member States, the Commission and the European Board for Digital Services (Art. 11 and 12 of the Digital Services Act). The languages of communication are Italian and English.
9. No prior checks
We are under no general obligation to monitor (Art. 8 of the Digital Services Act) and we do not: uploaded photos and songs go through no automated filter and no review before publication, and we do not know what they contain until somebody tells us.
Whoever uploads content answers for it: under clause 7 of the Terms of Service the customer declares they hold the rights to what they publish, and undertakes to indemnify us if a third party comes after us because of them.
